Senior Associate Michelle de Vera Negotiates $167,000 Settlement in Client’s Discrimination, Workplace Harassment, and Reprisal Complaint Against the Department of Transportation

In 2021, the Client contacted Pitre & Associates to represent her in her Formal EEO Complaint against the Department of Transportation due to alleged disability discrimination and retaliation for her prior protected activity. The firm worked with the Client to ensure she provided the necessary testimony and documentary evidence to prove her claim during the EEO Investigative process. Unfortunately, during the investigative period, the Client was unjustly removed from her position at the Agency, and as a result, Pitre & Associates filed a Merit Systems Protection Board Appeal. Thereafter, Pitre & Associates also requested an EEOC hearing and zealously represented the Client before the EEOC, securing a partial denial of the Agency’s Motion for Summary Judgement. Upon receiving the partial denial, Pitre & Associates was able to successfully enter a global settlement that resolved all three of the Client’s cases. The global settlement included a rescission of the Agency’s Removal, the removal of any negative employment actions within the Client’s Official Personnel File, and a lump sum payment of $167,000, which included the payment of her attorney’s fees at Laffey Rates.
